Article 1 – Definitions

In these terms and conditions, the following terms are defined as:

  • Cooling-off period: The period within which the consumer can exercise their right of withdrawal.

  • Consumer: The natural person who is not acting in the exercise of a profession or business and enters into a distance agreement with the vendor.

  • Day: Calendar day.

  • Long-term transaction: A distance agreement concerning a series of products and/or services, of which the delivery and/or acceptance obligation is spread over time.

  • Durable data carrier: Any medium that allows the consumer or vendor to store information personally directed at them in such a way that future consultation and unchanged reproduction of the stored information is possible.

  • Right of withdrawal: The possibility for the consumer to cancel the distance agreement within the cooling-off period.

  • Vendor: The natural or legal person offering products and/or services at a distance to consumers.

  • Distance agreement: An agreement concluded under an organized system for remote sales of products and/or services, using one or more techniques for remote communication, exclusively until the conclusion of the agreement.

  • Remote communication technique: A means that can be used to conclude an agreement, without the consumer and vendor being simultaneously in the same location.

  • General Terms and Conditions: The present General Terms and Conditions of the vendor.

Article 3 – Applicability

These general terms and conditions apply to any offer by the vendor and any distance agreement and orders between the vendor and the consumer.

Before the distance agreement is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the agreement is concluded that the general terms and conditions are available from the vendor and will be sent free of charge at the consumer's request.

If the distance agreement is concluded electronically, the text of these general terms and conditions will be provided electronically to the consumer in such a way that they can easily be stored on a durable data carrier.

If one or more provisions of these general terms and conditions are wholly or partially invalid or voided, the agreement and these terms and conditions remain in effect, and the relevant provision will be promptly replaced by a provision that closely approximates the original intent.

Article 4 – The Offer

  • If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.

  • The offer is non-binding. The vendor is entitled to modify and adjust the offer.

  • The offer contains a full and accurate description of the products and/or services offered. The description is detailed enough for the consumer to make a proper assessment of the offer.

  • All prices exclude customs clearance fees and import VAT. These additional costs are the responsibility of the consumer.

Article 5 – The Agreement

  • The agreement is concluded when the consumer accepts the offer and meets the conditions set forth.

  • If the consumer has accepted the offer electronically, the vendor will promptly confirm receipt.

  • The vendor will provide necessary details regarding payment, delivery, warranties, and withdrawal rights.

Article 6 – Right of Withdrawal

  • Consumers have the right to withdraw from the agreement within 14 days of receiving the product.

  • During this period, the consumer must handle the product and packaging with care.

  • The consumer must notify the vendor in writing or by email if they wish to exercise their right of withdrawal.

  • If the product is not returned within 14 days of the withdrawal notice, the purchase is considered final.

Article 7 – Costs in the Event of Withdrawal

  • Consumers bear the costs of returning the product.

  • If the consumer has already made a payment, the vendor will refund the amount within 14 days after withdrawal, provided the product has been returned.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  • Personalized or custom-made products.

  • Products that cannot be returned due to their nature.

  • Hygiene products with broken seals.

Article 9 – The Price

  • Prices remain valid during the stated offer period.

  • Price increases within 3 months after the agreement is concluded are only permitted due to statutory regulations.

  • The vendor is not responsible for printing or typographical errors in pricing.

Article 10 – Conformity and Warranty

  • The vendor guarantees that the products conform to the agreement and the provided specifications.

  • A product is not considered defective if improper use or maintenance by the consumer causes the issue.

Article 11 – Delivery and Execution

  • The vendor will take the utmost care when processing and delivering orders.

  • If delivery is delayed or an order cannot be executed, the consumer will be informed within 30 days of order placement.

  • If an order cannot be fulfilled, the consumer is entitled to a full refund within 14 days.

  • The risk of damage or loss of products remains with the vendor until delivery to the consumer.

Article 12 – Payment

  • Payments must be made immediately upon order placement unless otherwise agreed.

  • Consumers must notify the vendor of any inaccuracies in payment details immediately.

  • In case of non-payment, the vendor has the right to charge reasonable collection costs.

Article 13 – Complaints and Disputes

  • The vendor has a complaint procedure and will handle complaints according to this process.

  • Complaints must be submitted within a reasonable timeframe after identifying an issue.

  • If a dispute cannot be resolved, the consumer has the right to submit complaints via the European Commission’s Online Dispute Resolution (ODR) platform.

Article 14 – Additional or Different Provisions

  • Any additional provisions will not be to the consumer's disadvantage and must be recorded in writing.
